Is the house under a landscape or heritage constraint?
A constraint does not stop you buying, but it decides what you can change: in a protected landscape area many exterior works need landscape authorisation, listed heritage needs the Soprintendenza’s, and its sale is subject to the State’s pre-emption right.
Landscape: articles 136 and 142
Art. 136 of the Code of Cultural Heritage and Landscape protects buildings and areas of significant public interest declared by a decision; art. 142 protects whole categories by law, such as coastal and lake strips and forested land. The art. 142 categories do not apply to areas that were in zone A or B on 6 September 1985: a fact the open registers do not show and that is checked at the Comune.
The Ministry of Culture’s national system is, by its own statement, incomplete and without certifying value: the best sources are the regional landscape plans and, for a specific case, the Soprintendenza.
What you can do with a property also depends on other rules, such as Piano Casa extensions and planning and cadastral compliance. For one address, the free Dossier Immobile preview brings them together.
Listed heritage and pre-emption
If the house is cultural heritage, the sale must be notified and the State may exercise pre-emption within sixty days of the notice, or within one hundred and eighty days if the notice is missing, late or incomplete; meanwhile the deed is subject to a suspensive condition (arts. 59-61 D.Lgs. 42/2004). Some assets, for example of public bodies or non-profit legal persons and over seventy years old, are protected pending verification of their cultural interest (art. 12).
Burnt areas
In woods and pastures hit by fire the use may not change for fifteen years and nothing may be built for ten years; deeds of sale within fifteen years must mention the constraint, on pain of nullity (art. 10 L. 353/2000). The register with legal force is the municipal register of burnt areas.
What Dossier Immobile does
It shows Natura 2000 areas at the selected location and within 1 km, the dossier’s search distance (not a legal threshold). Landscape constraints, listed heritage and the municipal register of burnt areas: these checks are not part of this dossier, which refers you to the Comune or the Soprintendenza without ever writing ‘no constraint’.
Can I install solar panels under a constraint?
Renewable energy installations have a separate regime: D.Lgs. 190/2024, as amended also by D.Lgs. 178/2025, distinguishes free activity, a simplified authorisation procedure and a single authorisation. The regime depends on the installation, its features and its location, also in protected areas or on protected buildings. Check with the Comune.
