When do you need a certificato di destinazione urbanistica?
The certificato di destinazione urbanistica (CDU) must be attached to deeds concerning land, on pain of nullity. It is not needed when the land belongs to a building registered in the urban cadastre and the area is under 5,000 m² (art. 30 D.P.R. 380/2001): so most houses are sold without a CDU.
What the law says
- The Comune issues the CDU within a mandatory deadline of thirty days from the request.
- It is valid for one year from issue, if the planning instruments have not changed.
- If the Comune does not issue it in time, the seller may replace it with a declaration.
What you can do with a property also depends on other rules, such as planning and cadastral compliance and Piano Casa extensions. For one address, the free Dossier Immobile preview brings them together.
Why it matters for a house too
The law also has some burdens noted in the CDU, such as that of a remediation carried out by the authorities (art. 253 D.Lgs. 152/2006). A house sold without a CDU does not carry this information into the deed: it is worth looking for it in the registers first.
Costs
Fees and revenue stamps vary from one Comune to another: check your Comune’s fee schedule.
What Dossier Immobile does
The dossier is not a CDU and does not replace it. It gives the general rule on the CDU and shows the plan zone where it is open data.
I am buying a house with a large garden: is a CDU needed?
The general rule: the exemption applies to land that is appurtenant to a building in the urban cadastre, with a total appurtenant area under 5,000 m²; the area alone is not enough. The notary assesses the specific case.
